Douglass (Mont.) man arrested for assault
NORRISTOWN – A Douglass (Mont.) man is headed to jail for
assaulting another man on a parking lot outside a township tavern.
Kenneth E. Jabs Jr., 27, of the 100 block of Paper Mill Road, was sentenced in Montgomery County Court to 30 days to 23 months in the county jail and 24 hours of community service after he pleaded guilty to a misdemeanor charge of simple assault in connection with a July 9, 2011, incident on the parking lot of the Red Hill Tavern.
Judge Richard J. Hodgson, who accepted a plea agreement in the matter, ordered Jabs to report to the jail on March 30 to begin serving the sentence. The judge said Jabs, who was represented by defense lawyer Adam Sager, can serve the minimum sentence over the course of consecutive weekends.
As a condition of the sentence, the judge also ordered Jabs to have no contact with the victim, identified in court papers as Robert Bertolette, whose age and address were not contained in court papers.
An investigation began about 1:50 a.m. July 9 when Douglass (Mont.) police responded to the parking lot in the 1000 block of East Philadelphia Avenue for a report of an assault victim injured in the parking lot, according to the criminal complaint.
“On arrival, we observed the victim, Robert Bertolette, on the ground near the main entrance bleeding heavily from the head,” Douglass (Mont.) Police Corporal Brian Steffie alleged in the arrest affidavit.
Due to the seriousness of the victim’s injuries, police initially were going to airlift Bertolette to a hospital but a helicopter was unable to fly due to weather conditions, court documents indicate. So, arriving emergency officials transported Bertolette to an undisclosed medical trauma facility for treatment of his injuries.
A witness at the scene told police Jabs struck the victim in the head, which caused the victim to fall to the ground and strike his head on the paved portion of the parking lot, Steffie alleged. According to the witness, Jabs then got into a vehicle and left the scene, court documents indicate.
Court papers did not indicate what precipitated the assault.
By pleading guilty to simple assault, Jabs specifically admitted that he attempted to cause or intentionally, knowingly or recklessly caused bodily injury to Bertolette. Other charges of aggravated assault, harassment and disorderly conduct were dismissed against Jabs as part of the plea agreement.
